These gen\u00ader\u00adal terms and con\u00addi\u00adtions (GTC) apply to con\u00adtracts on www.madlsekt.at<\/a>\/shop between the Sek\u00adthaus Chris\u00adt\u00adian Madl, Ing.Christian Madl, Haupt\u00adstra\u00dfe 57, A\u20112172 Schrat\u00adten\u00adberg and the cus\u00adtomer in the ver\u00adsion valid at the time the respec\u00adtive con\u00adtract was con\u00adclud\u00aded. Dif\u00adfer\u00adent terms and con\u00addi\u00adtions are not valid unless the Sek\u00adthaus Chris\u00adt\u00adian Madl has agreed to them in writ\u00ading before accept\u00ading the order. By plac\u00ading an order, the cus\u00adtomer agrees to these gen\u00ader\u00adal terms and conditions.<\/p>\n

II. Offers and con\u00adclu\u00adsion of contract<\/h1>\n

The con\u00adtract and busi\u00adness lan\u00adguage is Ger\u00adman. All offers of the Sek\u00adthaus Chris\u00adt\u00adian Madl are, with respect to avail\u00adabil\u00adi\u00adty, non\u00adbind\u00ading and with\u00adout any oblig\u00ada\u00adtion. A there\u00adof result\u00ading deliv\u00adery delay is pos\u00adsi\u00adble. Images in the online shop only rep\u00adre\u00adsent sym\u00adbol\u00adic pho\u00adtos or labels. Cur\u00adrent\u00adly avail\u00adable vin\u00adtages may dif\u00adfer. The prod\u00aducts in the online shop do not yet con\u00adsti\u00adtute an offer. A pur\u00adchase con\u00adtract is con\u00adclud\u00aded by the buy\u00ader\u2019s online order (specif\u00adi\u00adcal\u00adly by: click\u00ading on \u201cBuy now\u201d) and our order con\u00adfir\u00adma\u00adtion, which we send in a reg\u00adu\u00adlar way by email. By plac\u00ading the order, the cus\u00adtomer assures that he or the recip\u00adi\u00adent of the goods is old\u00ader than 18 years!<\/p>\n

III. Place of ful\u00adfill\u00adment, trans\u00adfer of risk and place of jurisdiction<\/h1>\n

The place of ful\u00adfill\u00adment for all ser\u00advices from the trans\u00adac\u00adtions between the con\u00adtract\u00ading par\u00adties is the place of busi\u00adness of the Sek\u00adthaus Chris\u00adt\u00adian Madl, Haupt\u00adstra\u00dfe 57, A\u20112172 Schrat\u00adten\u00adberg, even if the goods are trans\u00adferred to anoth\u00ader loca\u00adtion as agreed. If the goods are picked up per\u00adson\u00adal\u00adly or deliv\u00adered by the Sek\u00adthaus Chris\u00adt\u00adian Madl, the risk is trans\u00adferred to the cus\u00adtomer through that per\u00adson\u00adal deliv\u00adery. In the case of an exter\u00adnal deliv\u00adery, the risk is trans\u00adferred to the cus\u00adtomer when the goods of Sek\u00adthaus Chris\u00adt\u00adian Madl are hand\u00aded over to the trans\u00adporter or par\u00adcel ser\u00advice. The deliv\u00adery is cov\u00adered by a trans\u00adport insur\u00adance at DPD. The com\u00adpe\u00adtent dis\u00adtrict court in Mis\u00adtel\u00adbach is agreed as the exclu\u00adsive place of jurisdiction.<\/p>\n

IV. Price, due date<\/h1>\n

All prices are list\u00aded in EURO and include the applic\u00ada\u00adble sales tax of the Repub\u00adlic of Aus\u00adtria. The cur\u00adrent\u00adly valid sparkling wine tax is includ\u00aded in the sales price. The prices include glass, pack\u00adag\u00ading and pack\u00adag\u00ading com\u00adpli\u00adance fees (ARA). Gift box\u00ades and cus\u00adtomized labels are express\u00adly exclud\u00aded. The prices on the day of the order apply. The invoice amount is due 10 days after the invoice date with\u00adout any deduc\u00adtion. Pay\u00adment is only deemed to have been made when the Sek\u00adthaus Chris\u00adt\u00adian Madl can dis\u00adpose of the amount. We allow our\u00adselves to charge reminder fees of 3% of the gross price from the due date.<\/p>\n

V. Order quan\u00adti\u00adty, type of deliv\u00adery and costs<\/h1>\n

When order\u00ading in the online shop, a min\u00adi\u00admum quan\u00adti\u00adty of 6 bot\u00adtles each 0.75 liter of sparkling wine or wine is required. The total order quan\u00adti\u00adty should be divis\u00adi\u00adble by 6. Deliv\u00adery is usu\u00adal\u00adly car\u00adried out by the par\u00adcel ser\u00advice DPD. Upon writ\u00adten cus\u00adtomer request, deliv\u00adery can also be made via \u00d6ster\u00adre\u00adichis\u00adche Post AG. For deliv\u00ader\u00adies with\u00adin Aus\u00adtria, the deliv\u00adery costs are includ\u00aded in the price of the goods. VI. Pay\u00adment<\/h1>\n

Pay\u00adment of the goods and any ship\u00adping costs is made by bank trans\u00adfer to our account: IBAN: AT80 3298 5001 0180 6470, BIC: RLNWATWWZDF, Raif\u00adfeisen\u00adbank Wein\u00advier\u00adtel Nordost.
\nThe goods remain the prop\u00ader\u00adty of the Sek\u00adthaus Chris\u00adt\u00adian Madl pend\u00ading pay\u00adment in full.<\/p>\n

VII. Right of Withdrawal<\/h1>\n

You have the right to can\u00adcel this con\u00adtract with\u00adout giv\u00ading any rea\u00adson with\u00adin four\u00adteen cal\u00aden\u00addar days. The can\u00adcel\u00adla\u00adtion peri\u00adod is four\u00adteen cal\u00aden\u00addar days from the day on which you or a third par\u00adty named by you, who is not the for\u00adwarder, took pos\u00adses\u00adsion of the goods. You can use the attached copy of a with\u00addraw\u00adal form, but this is not manda\u00adto\u00adry. To safe\u00adguard the right of with\u00addraw\u00adal, it is suf\u00adfi\u00adcient for you to send your com\u00admu\u00adni\u00adca\u00adtion regard\u00ading your exer\u00adcise of the right of with\u00addraw\u00adal before the with\u00addraw\u00adal peri\u00adod has expired.<\/p>\n

CON\u00adSE\u00adQUENCES OF THE WITHDRAWAL<\/h2>\n

If you can\u00adcel this con\u00adtract, we have to pay back all pay\u00adments we have received from you, includ\u00ading any deliv\u00adery costs, imme\u00addi\u00adate\u00adly and at the lat\u00adest with\u00adin four\u00adteen days from the date on which we received the noti\u00adfi\u00adca\u00adtion of your can\u00adcel\u00adla\u00adtion of this con\u00adtract. For this repay\u00adment, we use the same means of pay\u00adment that you used in the orig\u00adi\u00adnal trans\u00adac\u00adtion, unless express\u00adly agreed oth\u00ader\u00adwise with you. Under no cir\u00adcum\u00adstances will you be charged any fees for this repay\u00adment. We can refuse repay\u00adment until we have received the goods back or until you have pro\u00advid\u00aded proof that you have returned the goods, whichev\u00ader comes first. You must return or hand over the goods to us at Sek\u00adthaus Chris\u00adt\u00adian Madl, Haupt\u00adstra\u00dfe 57, A\u20112172 Schrat\u00adten\u00adberg, at the lat\u00adest with\u00adin four\u00adteen days from the day on which you inform us of the can\u00adcel\u00adla\u00adtion of this con\u00adtract. The dead\u00adline is met if you send off the goods before the peri\u00adod of four\u00adteen days has expired.<\/p>\n

VIII. Cork Taste<\/h1>\n

The Sek\u00adthaus Chris\u00adt\u00adian Madl is not respon\u00adsi\u00adble for any taste impair\u00adments caused by cork taste. Such bot\u00adtles are exchanged under the fol\u00adlow\u00ading con\u00addi\u00adtions: The bot\u00adtle is closed again with the bad cork and returned to the Sek\u00adthausChris\u00adt\u00adian Madl. Deliv\u00adery costs have to be paid by the customer.<\/p>\n

IX. Reten\u00adtion of Title<\/h1>\n

The deliv\u00adered goods remain the prop\u00ader\u00adty of the Sek\u00adthaus Chris\u00adt\u00adian Madl until full pay\u00adment of the pur\u00adchase price, includ\u00ading the costs to be borne by the customer.<\/p>\n

X. Pro\u00adtec\u00adtion of Minors<\/h1>\n

The sale and deliv\u00adery of wine and spir\u00adits can only be made to peo\u00adple old\u00ader than 18 years. In order to com\u00adply with the legal reg\u00adu\u00adla\u00adtions, Sek\u00adthaus Chris\u00adt\u00adian Madl is enti\u00adtled to deliv\u00ader goods only after legit\u00adi\u00adma\u00adtion by means of an offi\u00adcial pho\u00adto ID. In the case of a jus\u00adti\u00adfied deliv\u00adery refusal, the cus\u00adtomer is oblig\u00aded to com\u00adpen\u00adsate for the dam\u00adage actu\u00adal\u00adly incurred (e.g. costs of deliv\u00adery). By plac\u00ading the order, the cus\u00adtomer assures that he or the recip\u00adi\u00adent of the goods is old\u00ader than 18 years.<\/p>\n

Should one or more pro\u00advi\u00adsions of this con\u00adtract be inef\u00adfec\u00adtive, the valid\u00adi\u00adty of the remain\u00ading pro\u00advi\u00adsions remains unaf\u00adfect\u00aded.
